Critical Employer Update for  the I-9 Process

Employer Alert!  There are two recent and important changes to the I-9 process for employers.  

New I-9 Form

The USCIS has published a new version of the I-9 form – Edition 8/1/2023.  Employers can start using it immediately, although the old version (edition 10/21/19) is permissible for use up until October 31, 2023.  Effective November 1st, all employers must use the new form.

Remote Documentation Inspection Update

During the pandemic, employers were allowed to conduct a remote inspection of the employee documents required to complete the I-9.  The Department of Homeland Security ended these flexibilities on 7/31/2023. 

Employers who are not enrolled in E-Verify, and who viewed employee documents virtually must now complete an in-person physical inspection of the documents no later than August 30, 2023.  In the additional information section on Page 2, the employer should note when the documents were remotely examined, and add a note with the date that the documents were physically inspected.

E-Verify Considerations

Employers who are enrolled in E-Verify and conducted a remote examination of the documents have a different process to follow by August 30. 

Employers who wish to enroll in E-Verify will be able to continue to inspect documents remotely. This may be a better option for employers who hire remote workers or who have several locations.
